Massachusetts Bill H4538 Accompanied in House

A Massachusetts bill that affects auto glass businesses has been updated. In March of 2010 the bill was reported favorably by the committee and referred to the House Committee On Ways and Means. Just this past week the bill was updated in the House as “accompanied H5080.”
The bill states that an insurer, insurance agent, producer, adjuster or third party administrator may not, “use or employ unfair or deceptive acts or practices for the purpose of inducing a person to use a particular motor vehicle glass repair shop to provide motor vehicle glass repair services.” It goes on to explain that dispatching the job to any shop other than the consumer’s requested shop would be outlawed.
The bill also states that the consumer’s choice is not up for discussion. The bill reads that the insurer, insurance agent, producer, adjuster or third party administrator should not be, “engaging in any act or practice designed to intimidate, threaten, or coerce any person to use, or for having used, a particular motor vehicle glass repair shop.”
