Files $11,000 Administrative Claim in Diamond Case

Yahoo! HotJobs has filed an administrative claim in the amount
of $11,148.10 against Diamond Glass for "certain amounts that
[Diamond] failed to remit to Yahoo! Post-petition." According
to the claim statement, filed in the U.S. Bankruptcy Court for the
District of Delaware, Yahoo! had submitted three invoices, totaling
the amount of the claim, between May 28 and June 20, 2008 for post-petition
recruiting/advertising services on its HotJobs site.
The company alleges that it continued to provide these services
to Diamond from May 28, 2008, through November 27, 2008, even though
the company had not paid for the service since filing for bankruptcy
on April 1, 2008.
"In the present case, Yahoo! is entitled to administrative
expense priority," writes the company. "The administrative
claim relates to amounts that the Debtor was required to remit to
Yahoo! for post-petition recruiting/advertising services that it
provided through November 27, 2008."
The statement continues, "Moreover, the Debtor has undoubtedly
benefited from receiving the support services from Yahoo!."
The statement was filed with the court on May 22 by the law firms
of Pinckney, Harris & Weidinger LLC and Bialson, Bergen &
Schawb, counsel for Yahoo! Inc.
