Belron Motions for Further Extension in Levesque Case; Reports That Parties are Finalizing a Settlement Agreement
Belron US has filed a third motion for a 30-day extension of time to answer former employee Michelle Levesque's counterclaim in the suit in which the two are involved, citing that the two parties "are currently finalizing a Settlement Agreement that will likely resolve the case." According to the motion, filed last week, Levesque and her counsel had consented to the motion as well. (CLICK HERE for related story.)
"Belron has provided a draft Settlement Agreement to Levesque and is awaiting Levesque's comments on the Agreement," writes Jennifer Belli of Bello Black & Welsh LLP, counsel for Belron US, in the motion. "Belron understands that Levesque is currently traveling out of the country. The parties thus need additional time to finalize the Settlement Agreement."
In the original complaint, filed by Belron US in August, the Columbus, Ohio-based company alleged that Levesque and an associate, Edward Lee, solicited Belron US employees to leave the company and join a new venture. (CLICK HERE for related story.) Lee has yet to answer the complaint filed against him in the U.S. District Court for Southern New York.
Levesque had filed her answer and a counterclaim in September denying many of the allegations and claiming that Belron US required her to work during leave taken under the Family Medical Leave Act (FMLA) and did not pay her for doing so, among other claims. (CLICK HERE for related story.)
Belron previously had requested an extension until Monday, October 27, and then later a further two-week extension-until November 10, 2008, both of which were granted.
