In addition, the court will review the debtors', now known as DG Liquidation Corp., second amended chapter 11 plan of liquidation, filed on September 22. In conjunction with the hearing, the court has set December 12 as the deadline for Plainfield, which had previously filed suit against Levine for allegedly delaying the company's bankruptcy filing in an effort to preserve $10 million he invested in the company, to file an objection to the second amended plan.
The hearing will be held at 10:30 a.m. on December 30 in Wilmington, Del.
