Court: Safelite-Minnesota Case Must Be Ready for Summer Trial

The U.S. Federal District Court for Minnesota has issued a scheduling order in the Safelite-Minnesota case saying all parties must be ready for a bench trial by August 29, 2016. Safelite Group and Safelite Solutions filed the lawsuit in U.S. Federal District Court in April 2015 to enjoin and declare invalid enforcement of a Minnesota statute which excludes the company “from doing business in Minnesota without the opportunity for a hearing.”

Minnesota Case Takes One Step Closer to Trial

The case between Safelite Group, Safelite Solutions and the Minnesota Commerce Commissioner is moving closer to trial. Safelite Group had sued the commissioner and asked the U.S. District Court of Minnesota for a preliminary injunction to enjoin and declare invalid enforcement of a Minnesota statute which excludes “Safelite from doing business in Minnesota without the opportunity for a hearing.”

Safelite Calls Minnesota Commerce Commissioner’s Response a “Red Herring”

Safelite Group and Safelite Solutions attorneys says the Minnesota Commerce Commissioner is attempting “to distract attention from the unconstitutional speech restrictions by asserting that Safelite is ‘engaged in the unlicensed adjusting of insurance claims.’” The attorneys call this a “red herring” and say the crux of the case is about the company’s right to free speech, not licensed claims adjustment.

Safelite Asks U.S. District Court for Preliminary Injunction

Safelite Group and Safelite Solutions have asked the U.S. District Court of Minnesota to issue a preliminary junction to temporarily halt enforcement of a Minnesota statute it contends prohibits “insurers and insurance claims processors from engaging in truthful commercial speech.”

Minnesota Insurance Department Asks State Supreme Court to Deny Safelite’s Petition

Minnesota’s Department of Commerce, Insurance division, has asked the Minnesota Supreme Court to deny Safelite Group and Safelite Solutions petition for review. Safelite asked for the review of a decision by the Appellate Court that upholds the settlement agreement between the Minnesota Department of Commerce, Insurance Division, and Auto Club Group.

Safelite Asks Minnesota Supreme Court to Review Cease and Desist Order from Insurance Division

Safelite Group and Safelite Solutions have petitioned the Minnesota Supreme Court to review a decision by the appellate court that upholds the settlement agreement between the Minnesota Department of Commerce, Insurance Division, and Auto Club Group. The settlement requires Auto Club Group to “cease and desist from using Safelite Solutions, or any other subsidiary of Safelite Group Inc., as its administrator of automotive glass claims in Minnesota,” according to the settlement agreement.

Minnesota Department of Commerce Commissioner Settles with the Auto Club Group

The Minnesota Department of Commerce, Insurance Division, has entered a settlement agreement with the Auto Club Group that provides for the Auto Club Group to pay a civil penalty of $150,000 and “cease and desist from using Safelite Solutions, or any other subsidiary of Safelite Group Inc. as its administrator of automobile glass claims in Minnesota,” according to the settlement agreement.
